InsideCounsel produces Special Report on e-Discovery in May issue

CHICAGO, IL (May 17, 2010) –Inside Counsel, a Summit Business Media publication, and e-Discovery Institute’s Co-Founder and General Counsel Patrick Oot, invited nine leading in-house counsel experts to discuss of their challenges regarding litigation discovery.   Using the TelePresence conference system of Cisco Systems Inc., experts were able to share and discuss, via a virtual roundtable, how increased amounts of data, emerging case law, pressure from outside counsel and amendments to the Federal Rules of Civil Procedure have contributed to the difficulties corporate legal departments face.  

“We need to educate the judiciary, corporate colleagues and outside counsel that the standard of reasonableness isn’t a standard of perfection,” Oot remarked. “Neither anticipate the real burden involved in searching, preserving and producing data at a large organization.”

Vice President & Deputy General Counsel to Guidance Software, Inc. Patrick E. Zeller served as moderator. Final thoughts from the panel focused on the need for more understanding of the true costs that discovery expenses impose, the desire for more information about new search methodologies and a call for courts to provide predictable rationale that litigation can apply to cases, systems, applications, personnel and data. “Right now it’s like shooting buckshot into the wind, not knowing if you will hit anything,” Fishman exclaimed.
